Privacy Policy.

How Machells Construction collects, uses, stores and discloses personal information — in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.

We take your privacy seriously.

Machells Construction Pty Ltd (ABN 24 681 868 959) ("Machells", "we", "us", "our") is committed to protecting the privacy of the personal information we collect and hold. This policy sets out how we handle that information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

By engaging with us — whether you're a client, subcontractor, supplier, employee, candidate, or website visitor — you acknowledge that you have read and understood this policy. If you don't agree with how we handle personal information, please don't provide it to us.

We review this policy periodically. The version published on this page is the version currently in force.

The personal information we collect.

We only collect personal information that is reasonably necessary for our functions or activities as a carpentry and construction contractor. The types of information we may collect include:

Contact information — name, company, role, email address, postal address, and phone number.

Project information — scope documents, drawings, site addresses, correspondence, and any other information you provide when enquiring about or engaging us for a project.

Commercial information — ABN, trade licence and insurance details, bank details for payment, and pricing or variation correspondence.

Workforce information — for employees, subcontractors and candidates: White Card and trade qualification details, induction records, tax file numbers (employees only), superannuation details, and emergency contact information.

Site & safety information — SWMS acknowledgements, induction sign-ons, incident reports, and photographic records of works in progress.

Website information — when you use our website, we may collect your IP address, browser type, device information, referring pages, and interactions with our content (see section 06 below on cookies).

How information reaches us.

Wherever practical, we collect personal information directly from you — through our enquiry form, over email, on the phone, in meetings, or through documents you submit during tender, quoting, onboarding or project delivery.

In some cases we may receive information about you from a third party, such as a head contractor, referee, certifier, or government regulator. Where we do so, we will take reasonable steps to let you know.

You can deal with us anonymously or under a pseudonym where it's lawful and practical to do so. In most commercial and construction contexts, however, we need to know who we're dealing with in order to quote, contract, or engage.

How we use your information.

We use the personal information we collect to:

— respond to enquiries, prepare quotes, and deliver the scope you've engaged us for;
— manage our crews, subcontractors and suppliers on site;
— meet our obligations under building, safety, workers' compensation, tax and employment laws;
— manage payments, invoicing, and commercial correspondence;
— communicate with you about current projects, and — where you've consented — about our capabilities and future work;
— maintain business records, and improve how we run projects.

We do not sell your personal information. We may disclose it to: head contractors, consultants, certifiers and other parties involved in a project; our insurers, legal advisers and accountants; our IT, cloud storage and payroll providers acting on our behalf; and government or regulatory bodies where required by law.

Where we disclose information to a third party, we take reasonable steps to ensure they handle it consistently with this policy and the APPs.

How we store and protect it.

We take reasonable steps to protect the personal information we hold from misuse, interference, loss, unauthorised access, modification or disclosure. These steps include access controls on our systems, staff training, confidentiality obligations in our contracts, and use of reputable cloud and back-office providers.

Where personal information is no longer needed for any purpose for which it may be used or disclosed — and we aren't required by law to keep it — we will take reasonable steps to destroy or de-identify it.

No method of storage or transmission is 100% secure. If you have reason to believe your interaction with us is no longer secure, please contact us immediately using the details in section 10 below.

Cookies and website analytics.

Our website uses cookies and similar technologies to help it function properly, remember your preferences, and understand how visitors interact with our content. The information collected is generally aggregated and doesn't personally identify you.

You can configure your browser to refuse or alert you about cookies. If you do, parts of the site may not function as intended.

Our website may contain links to external sites. We're not responsible for the privacy practices of those third parties and recommend you review their policies before providing personal information.

Accessing and correcting your information.

You have a right under the Privacy Act to ask for access to the personal information we hold about you, and to ask us to correct it if it's inaccurate, out-of-date, incomplete, irrelevant or misleading.

To make a request, contact us using the details in section 10. We'll respond within a reasonable period — usually within 30 days. There is no fee to request access or correction, though in some cases we may charge a reasonable cost for locating and copying records.

In certain circumstances we may decline a request — for example, where giving access would have an unreasonable impact on someone else's privacy, or where it's required or authorised by law. If we do decline, we'll tell you why in writing.

Direct marketing & opting out.

From time to time we may use your contact details to send you information about our capabilities, completed projects, or services we think would be relevant to you — always in line with the Spam Act 2003.

Every marketing communication we send includes a simple way to opt out. You can also ask us to stop at any time by emailing projects@machellsconstruction.com.au. We'll action the request promptly.

Overseas storage and disclosure.

Some of our IT, email and cloud storage providers operate data centres outside Australia. Where personal information is stored or processed overseas, we take reasonable steps to ensure the overseas recipient handles it consistently with the Australian Privacy Principles.

By providing personal information to us, you consent to this kind of overseas storage or disclosure for the purposes outlined in this policy.

Concerns, complaints, or questions.

If you think we've mishandled your personal information or breached the Australian Privacy Principles, please let us know. We take complaints seriously and want the chance to put things right.
